Terms of Use

This EULA is concluded between you and Smart Calendars AI ("Smart Calendars AI," "we," "us," or "our"). Our contact details are set out in §20.

We grant you a limited, non‑exclusive, non‑transferable, revocable license to install and use the App and related components solely for your personal or internal business use, in accordance with this EULA and any usage rules of the store or platform where you obtained the App. You may not resell, sublicense, reverse‑engineer, interfere with security, or use the Service in violation of applicable law.

Provide accurate information, keep your credentials secure, and notify us of any unauthorized use. You're responsible for all activity under your account.

Web purchases are processed by Stripe (or our payment processor shown at checkout). Prices and tax are shown before you pay, and receipts are emailed.

In‑app purchases follow the rules of the app store where you buy (e.g., Apple App Store). Billing, cancellations, and refunds for those in‑app purchases are handled by that store. We may update pricing with reasonable notice for future terms.

To keep the service fast and reliable, we may rate‑limit high‑volume use (for example, around 30 requests/hour per user) and block abusive behavior.

You retain ownership of content you submit. You grant us the rights necessary to process it to provide features like event extraction and Calendar Links. Don't upload illegal, harmful, or infringing material; ensure you have the right to share what you submit.

AI‑generated results may be inaccurate or incomplete. You must review output before relying on it. The Service is provided "as is" to the maximum extent permitted by law.

When creating Calendar Links, you confirm you have the right to share the linked content. Links expire based on the time you choose. We may block unsafe or abusive links.

You must comply with applicable third‑party terms when using the App.

We are responsible for maintenance and support of the App and Service, except where a store provider's rules say otherwise. Store providers (like Apple) have no obligation to furnish support for our App.

To the extent not disclaimed by law, we provide any warranties that apply under this EULA. If you bought the App from a store and it doesn't conform to a warranty, you may be entitled to a purchase‑price refund from that store; any other claims, losses, or costs arising from warranty issues are our responsibility, subject to §18 (Liability).

We're responsible for addressing claims by you or third parties relating to the App or your use, including product‑liability claims, failure to meet legal/regulatory requirements, and consumer‑protection or privacy claims. You must comply with all applicable laws when using the Service.

We (and our licensors) own the App and all related IP. If a third party claims the App infringes their IP, we will be solely responsible for investigating, defending, settling, and discharging that claim.

No misuse, including: interfering with security or access controls; probing or scanning; using the Service to violate others' rights or laws; scraping where disallowed; or attempting to bypass limits.

We may add, change, or remove features from time to time. The Service may be subject to planned or unplanned downtime; unless agreed otherwise in a separate written service-level agreement, no uptime commitment is provided.

You may stop using the Service at any time. We may suspend or terminate access for violations, security risks, or legal reasons. Sections that by nature should survive termination will do so.

To the maximum extent permitted by law, neither party is liable for indirect or consequential damages, or loss of data, profits, or business. Our aggregate liability for all claims in the 12 months before the claim is limited to the amounts you paid for the Service in that period. Nothing limits liability that cannot legally be limited.

Unless local law requires otherwise, this EULA is governed by the laws of Germany, and disputes will be handled by the competent courts in Germany.

If we make material changes, we'll give at least 30 days' notice. Continued use after the effective date means you accept the updated terms.

These supplemental terms apply only if you downloaded the App from the Apple App Store. If there's any conflict between this Addendum and the rest of the EULA, this Addendum controls for iOS users.

Parties. This EULA is concluded between you and Smart Calendars AI only, not Apple. We, not Apple, are solely responsible for the App and its content.

Scope of license. Your license is non‑transferable and limited to use of the App on Apple‑branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance & support. We are solely responsible for maintenance and support for the App. Apple has no obligation to furnish any maintenance or support.

Warranty. We are solely responsible for warranties (express or implied by law) to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligations regarding the App; any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are our responsibility.

Product claims. We, not Apple, are responsible for addressing claims relating to the App or your possession or use, including: (i) product‑liability claims; (ii) any claim that the App fails to conform to legal or regulatory requirements; and (iii) claims under consumer‑protection, privacy, or similar laws (including in connection with any HealthKit/HomeKit use, if applicable). We do not limit our liability to you beyond what applicable law permits.

IP rights. In the event of any third‑party claim that the App or your possession and use of the App infringes that third party's intellectual‑property rights, we (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of the claim.

Legal compliance / export. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a \"terrorist‑supporting\" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Developer name & address. Our legal name, address, and contact information are in §20 and apply for iOS as well.

Third‑party terms. You must comply with applicable third‑party terms when using the App (for example, your wireless‑data service agreement).

Third‑party beneficiary. You and we acknowledge and agree that Apple and Apple's subsidiaries are third‑party beneficiaries of this EULA, and upon your acceptance of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third‑party beneficiary.

These terms apply if you installed our Chrome extension from the Chrome Web Store.

Permissions disclosure. The extension may request permissions (e.g., reading page content you select to create Calendar Links). We request only what's necessary for the features you use; you can revoke permissions in your browser.

Policies. Use of any extension must comply with the policies of the platform where you installed it (e.g., Chrome Web Store Developer Program Policies, Mozilla Add‑ons (AMO) policies, Microsoft Edge Add‑ons store policies, Raycast Store guidelines).

If you use our web app:

Payments & refunds are handled by our payment processor (see §4). Refunds are governed by our web billing terms and applicable law.

Browser compatibility. Some features may vary by browser.

These supplemental terms apply only if you access Smart Calendars AI through the ChatGPT Apps Directory. If there's any conflict between this section and the rest of the EULA, this section controls for ChatGPT app users.

Service access. The Smart Calendars AI ChatGPT app operates within ChatGPT's environment using the Model Context Protocol (MCP). Your use is subject to both these Terms and OpenAI's Terms of Use and Usage Policies.

Authentication & data. Currently, no separate authentication is required to use our ChatGPT app. We process only the data necessary to fulfill your calendar and contact card requests within the ChatGPT session. See our Privacy Policy section on "ChatGPT App & Data Handling" for details.

Platform compliance. You must comply with OpenAI's Terms of Use, Usage Policies, and ChatGPT Apps Directory guidelines when using our app through ChatGPT.

Service availability. The ChatGPT app depends on both our servers and OpenAI's ChatGPT platform. Service interruptions may occur due to either platform's maintenance or technical issues.

Third-party beneficiary. You acknowledge that OpenAI may enforce relevant portions of these terms as they relate to ChatGPT platform compliance.

Data processing. Calendar events and contact cards are generated based on your ChatGPT conversation context. Generated files (.ics and .vcf) are temporarily stored in memory for up to 1 hour to enable downloads on all devices, then automatically deleted. We do not store conversation history or personal data beyond what's necessary to fulfill your immediate request.
